Problema invatamantului

Problema învăţământului, recentă?!    Chiar şi din postura de observatori, amatori şi nespecializaţi, ai vieţii politice şi sociale a ţării, ne este aproape imposibil să trecem cu vederea criza în care se află învăţământul românesc. Statisticile sunt mai mult decât relevante în acest caz. Nu este nevoie decăt să verificăm rata de promovabilitate a examenului de Bacalaureat in ultimii ani, numărul studenţilor performeri care aleg calea universităţilor străinătăţii pentru a îşi definitiva studiile sau rezultatele pe plan internaţional la olimpiadele si concursurile de profil. În ciuda evidenţei lacunelor cu care se confruntă sistemul şi a nevoii imperative a unei soluţii, clasa politică s-a dovedit incapabilă de a localiza problemele esenţiale şi de a implementa o soluţie eficientă şi de durata. THE LIMITS OF THE INTERNATIONAL COURT OF JUSTICE’S ADVISORY JURISDICTION

INTRODUCTION The purpose of this paper is to address the limits of the ICJ’s advisory jurisdiction, from the legal and policy point of view. The paper first discusses the ICJ’s authority to render advisory opinions, it then presents an overview of how the advisory jurisdiction operates and it concludes by examining the effects of the Court’s advisory jurisdiction. The starting point is the opinion of Serbia’s representative who, while sponsoring the General Assembly Resolution for an Advisory Opinion on Kosovo’s Declaration of Independence stated: “The Court’s advisory opinion would provide politically neutral, yet judicially authoritative, guidance to many countries […] Supporting this resolution would also serve to reaffirm a fundamental principle: the right of any Member State of the UN to pose a simple, basic question on a matter it considers vitally important to the Court. Developing Countries and the WTO Dispute Settlement Understanding

Introduction Dispute Settlement was a highly controversial issue under the General Agreement on Tariffs and Trade (GATT) regime and caused a great deal of complaint, especially among developing countries. This dispute settlement system was, allegedly, power-based [1] , thus preventing developing countries from successfully defending their interests within the GATT Forum. Among the most important sources of criticism was the lack of deadlines for the consultation process [2] , the need for consensus for the approval of the panels’ decisions and the different procedural and substantive regimes provided by the GATT and Tokyo negotiation rounds, leading to extended “norm and forum shopping” [3] . Case note on T-85/09 Yassin Abdullah Kadi v European Commission Introduction On 15 October 1999 the Security Council (SC) adopted Resolution 1267, which provides that all the States must “freeze funds and other financial resources, including funds derived or generated from property owned or controlled directly or indirectly by the Taliban, or by any undertaking owned or controlled by the Taliban”. [1] This Resolution was later strengthened and reaffirmed by subsequent Resolutions. In order to implement the sanctions the European Council adopted Regulation No 467/2001.
